Policies
NOTICE: By commissioning or completing a finalized sale with the artist (me), the client (you) fully agrees to follow and abide by the artist's complete terms and conditions listed. Failure to follow or intentional breakage of the artist's TERMS OF SERVICE will result in termination of any incomplete commissions, or refusal to proceed with or finalize any general business transactions with the client. This may include the potential to be blocked and/or blacklisted from doing future business of any kind with the artist. However, this is NOT guaranteed, as this is determined on a case-by-case basis. Terms and conditions may be added, changed, or removed without further notice.
Please contact the artist if there are any issues.
Section I: General Guidelines
-
a. REJECTION OR TERMINATION: The artist retains full rights to reject or terminate any business transaction(s) between the client and himself. Reasons may include (but are not limited to): Lack of communication from the client, hostility, spamming of any kind, domineering, assertive, or demanding behavior, harassment, block evasion, unwarranted sexual messages, ominous or disturbing messages, stalking, participation in illegal activities, suspicion of art or character theft, impersonation, or any other inappropriate action or behavior. In the event that a paid service is terminated, the commissioner will be refunded either partially or in full. The artist is not required to inform the client of the reasoning that their business transaction has been rejected or terminated.
-
b. TURNAROUND TIME: The artist will strive and do his utmost to complete a commission within a reasonable time period (1 year is the estimated maximum time limit; this time limit is reserved for extraordinary cases such as extremely complex commissions and external factors that may cause the artist to not harbor access to his electronic devices; the typical turnaround time is 1-day minimum and 6-months maximum; commissions that exceed 90 days include one or more free illustrations, animations, comics, or stories and/or a partial refund). However, other matters may interfere with the artist's personal life that may cause the artist to become unavailable communication-wise, or may cause the artist to lag in regards to work on the client's commission. The remains include but are not limited to medical appointments, therapy sessions, contracting a physical illness, being hospitalized, recovery from surgery (rare), requiring an extended period to manage mental health, etc. By conjuring any business transactions with the artist, the client accepts that the turnaround time may be disrupted.
-
c. UNFINISHED PRODUCT: The artist retains full rights to repurpose any unfinished or partially completed work that has been terminated or refunded (whether partially or in full). This includes any sketches or linework that the artist has created. The character(s) featured will be altered so that it no longer resembles the client's character(s) (exceptions to this are generic designs that harbor no unique features), and repurposed into a YCH, a future commission, or a personal piece.
-
d. BLACKLISTING: Under certain circumstances, an individual may appear on the artist's blacklist. If an individual has been blacklisted, it is because they have disobeyed the artist's established terms and conditions, participated in one or more scams, or otherwise committed or participated in malicious actions. Blacklisted individuals are typically barred PERMANENTLY from future contact with the artist by any possible means, and cannot perform any kind of business transaction with the artist. The individuals may NOT circumnavigate the blacklist system. Any attempts may result in being blocked or reported.
-
e. ADULT COMMISSIONS: View the artist's F-list here for more information regarding the artist's preferences for adult commission. The client must be the legal age of consent in your area in order to receive a sexual commission from the artist.
-
f. ADDITIONAL CHARACTERS: The price increase for additional characters is per character. The limit is 14 prominent characters per canvas!
-
g. UNLISTED ITEMS: Please enquire about quotes for unlisted items (such as animations, comics, crafts, etc.)! Please consider donating to the artist's Ko-fi if the client would prefer stingier commissioning options!
-
h. SHIPPING: THE CLIENT WILL NOT BE RECEIVING A PHYSICAL ITEM. THIS IS DIGITAL-ONLY AND THE CLIENT WILL ONLY BE RECEIVING A DIGITAL FILE THAT THEY MAY PRINT OR USE FOR PERSONAL USE ONLY. The client may request the PSD file with all of the layers for an additional fee.
-
i. MINIMUM AGE: The client must be at least 16 years of age to commission the artist with explicit parental/guardian consent. There are no exceptions to this policy. The clients must provide screenshots of consent and/or the contact information of parents (text-only preferred; voice optional) for the artist to contact them with the request of express consent prior to the artist proceeding with the commission. This is for legal and financial purposes (i.e.: avoiding chargebacks due to fraud).
Section II: Ordering & Payment Process
-
a. COMMISSION DETAILS: Details are required to be given to the artist before payment is received. It is the client's responsibility to provide the artist with the appropriate information that is required for the commission. Additionally, clear references of all of the prominent elements of the artwork are required. This means the provided character reference must be simple to color-pick and have a clear view of all of the important details such as markings and clothing. For characters, an image depicting the character's body in full height is preferred, but optional if the desired artwork depicts cropping that displays anything above the knee. The artist does not accept references if they are low in resolution, warped, or otherwise have details that are difficult to decipher. If the artist suspects the character is stolen, it will be automatically rejected.
-
b. CURRENCY: The artist is currently a resident of the United States, therefore, the only accepted currency is United States dollars. Please be aware of this when completing any business transaction with the artist. If the client resides in another country, PayPal will automatically convert your currency to USD. If the client requires any assistance regarding currency conversion, please refer to this link for a free online conversion calculator.
-
c. PAYMENT: Commissions will not be added to the artist's queue, nor will the general business transaction be considered complete, until at least 30% of the payment has been issued by the client, once requested, and received by the artist. Currently, payment must be sent through PayPal. Clients have the option of selecting to send the payment themselves as goods/services (the username(s) utilized must be included in the notes section) or have an invoice sent to them by the artist after providing their PayPal email. Unless otherwise agreed upon, the client has a maximum of 72 hours to send payment, and if the client has not paid within that timeframe, the business transaction will be terminated and a 1-month cooldown for business transactions with the artist will be issued.
-
d. BEGGING OR HAGGLING: The artist reserves the right to not alter flat prices, add-on prices, surcharges, etc. The client is not permitted to request free or discounted artwork unless otherwise stated. Attempting to receive free/discounted labor is considered to be begging or haggling. This kind of behavior will never be tolerated. Repeatedly attempting to receive free or discounted artwork from the artist will result in being blacklisted and blocked, and block evasion to continue this behavior will result in being reported.
Section III: Commission Process
-
a. DEADLINES: If the client harbors a specified deadline, the client must order the commission at least 1 month prior to the deadline. If not, the artist will not be able to accept your commission.
-
b. UPDATES: Updates will be given periodically during the commission process. The purpose of this is to notify the client of what stage the product is at and to notify the client of its completion. The artist will always provide a sketch for the client to approve of, as well as screenshots of the other stages of the commission for approval purposes. If the client does not wish for this, the artist must be notified. Otherwise, the artist will default to the standard procedure. Payment will not be requested by the artist until the artist has commenced the creation process. The exception to this, however, regards uncolored sketches, where at least 30% pre-payment will be requested.
-
c. SKETCHING & ALTERATIONS: The client may request up to 5 individual subsidiary revisions to the foundation (sketch). However, any edit thereafter or any substantial modifications that require me to redraw a significant portion of the drawing will induce additional fees for compensation. The same regulations apply to the coloring and toning phases of the drawing.
-
d. COMPLETE REDRAWS: Any requisition for a complete redraw of your commissioned work (i.e.: "starting over from scratch") will induce a hefty additional fee.
-
e. FINISHED PRODUCT: The artist reserves the right to withhold the full-sized, high-resolution version of the finished product until the full payment for the entirety of the commission has been received. The artist will send a highly watermarked, low-resolution thumbnail of the finished product as evidence that the product has been completed. Once this procedure has occurred, the client must pay the rest of the bill before receiving the full version of the final product.
Section IV: Refund Policies
-
a. AVAILABILITY: If the client is eligible for a refund and wishes to receive it, the client must contact the artist through any of their provided contacts. The artist will review the message, and respond to the client's message once he becomes available, and if even prior to the artist suggesting alternative solutions, the client still wishes to receive a refund, the artist will manually issue a refund. Depending on the commission's stage in completion, it will either be a partial refund or a full refund.
-
b. PARTIAL REFUNDS: Once your commission has reached a specific stage in completion, a full refund is no longer available, in the event that the client wishes to terminate the commission. During the sketching phase, the client will receive 90% of their payment, during the lining stage, the client will receive 75% of what they have paid. Once it has reached the flat color stage, the client will receive 50% of their payment. Once the product has reached the initial toning stage(s), the client will be refunded 25% of what they have paid. The client will also be contacted about the refund. No refund is available after the product's completion.
-
c. FULL REFUNDS: If the artist is unable to complete the commission or the commission has been terminated and has not commenced, the client will automatically be refunded the full price they have paid for the commission. The client will also be contacted about the refund.
-
d. CHARGEBACKS: Random or unsolicited chargebacks on in-progress commissions (without any form of communication or agreement), finalized sales, completed commissions, or otherwise nonrefundable business transactions will be regarded as a form of scamming or fraud, and will be treated as such. If the client wishes to receive a refund regarding an in-progress commission, please follow the instructions listed at the beginning of this section.
Section V: Copyright & Usage
-
a. AUTHORSHIP: The client is not permitted to remove the artist's signature(s)/watermark(s), or otherwise claim the artist's creation as their own.
-
b. NON-COMMERCIAL: All standard commissions are considered personal and fall under non-commercial use. Clients should be aware of this upon ordering. This means the client is prohibited to utilize the non-commercial artwork they ordered for a profit of any kind, regardless of whether the use is physical or digital. The client is, however, entitled to utilize the final product for personal use, such as printing for personal posters, use on personal merchandise, use as an icon/banner/wallpaper/etc., use in virtual profiles, personal website(s), character storage, et al.
-
c. COMMERCIAL USE: The artist does not currently offer commercial-related business transactions or royalties. This may change in the future, and if so, will require a hefty surcharge for the client and a verbose discussion.
-
d. REUPLOADING & CREDIT: Any commissioned or purchased artwork is strictly prohibited for re-submission to ART GALLERY WEBSITES (such as deviantART and FurAffinity) without the artist's explicit permission. Personal and social websites are permitted, granted that the artist receives full and proper credit, and any official accounts the artist possesses are linked or tagged. If the artist already posted the artwork on any of his official accounts, the artist would prefer if the original post was shared directly instead.
-
e. ARTIST'S RIGHTS: The artist reserves the right to upload the client's commission(s) to their social media and personal website(s) and utilize them for advertisement. The only exception to this will be if the client specifically requests that their commission be kept privately.
-
f. PRIVATE COMMISSIONS: Private commissions are currently an available option. Commissions that are requested to be kept private by the client may solicit a minor surcharge by the artist due to the inability to use in the artist's portfolio and lack of exposure. The artist may decide to keep the commission private on their own terms and, as such, any fees will be waivered and the client is required to keep the artist anonymous if uploaded, and/or the client must only utilize a portion of the product publicly (e.g.: crop the image for use as an icon/avatar or banner).
-
g. CLIENT'S ALTERATIONS: The client must notify the artist and request permission if they intend to alter the product in any manner. The addition of certain filters (e.g.: Instagram or Snapchat filters) and modification of the angle of the commission is always permitted, however, redrawing a portion of the piece or any recoloring, for example, must only be done with the artist's permission. Failure to gain the artist's permission or notify him of the edit will result in the client being blacklisted and possibly reported.
-
h. AI & CRYPTOCURRENCY: The artist's commissioned and non-commissioned works are never to be sold or minted as non-fungible tokens (NFTs) or anything related to cryptocurrency. The artist's commissions and non-commissioned works are never to be utilized to train, validate, or test neural networks (AI).
Original text. A complete restructuring or rewrite of the policies may be issued if the original author requests it.
